Editorial deltaAI-indicated (source-linked)

BNSS 180 carries forward CrPC 161(1) and 161(3) character-identically, including the audio-video recording proviso and the woman-officer proviso for sexual-offence-victim statements. The proviso 2 trigger list is updated from IPC sections (354, 354A-D, 376, 376A-E, 509) to BNS sections 64-79 and 124. CrPC 161(2) - the witness duty to answer truly subject to a self-incrimination carve-out - is textually absent from BNSS 180. Whether that rule is reattached via a BNSS general provision or rests on Article 20(3) extrinsically is not visible on the face of BNSS 180 and remains a verification item.

Transitional note (repeal & savings)

For matters initiated before 1 July 2024, CrPC 161 continues to apply. For matters from that date forward, BNSS 180 applies. The transition is governed by the repeal-and-savings clause in the new code (BNS 358 / BNSS 531 / BSA 170 as the case may be); pending proceedings under the old code carry forward unaffected.
